It is all taking a bit longer than expected, but it now looks like the NIS2 directive will be introduced in the Netherlands in the second quarter of 2026. NIS2 aims to strengthen cybersecurity in the EU and align rules in that area. It will also come into force in the Netherlands in 2026. The Ministry of Justice and Security indicates that the introduction of the Cyberbeveiligingswet Cbw), as the NIS2 implementation law will be called, will take place in the second quarter of 2026.
Essential or important? Get to work!
Is your company a so-called essential or important entity? Then you fall under the NIS2 directive. And then there is work to be done, because you have to meet a hefty set of requirements and obligations. For instance, you have to perform a baseline measurement to see how well your security is in order, but also draw up a security policy, a continuity plan and an incident procedure. Plus introduce risk-mitigating measures, ensure the quality and safety of your supplier relations and train your employees in cybersecurity.
Are you not following the directive properly? Then sanctions lurk. And these can take serious forms. Natural persons in management within your company can be held personally (and potentially even criminally) liable.
Is NIS2 not applicable to your business? Then you may still have to deal with the NIS2 directive.
